If you don't have it anyone who creates clothes with it makes stuff that doesn't work? Like I really like studio-k's new hair but it doesn't show up in my game at all

Yes. OM said this before. If you create an item in a past sims 4 update, the people with new updates will see it just fine. However, people who create stuff with the new update will not show for previous updates. That is just how EA did it I guess. So you either update or don't see the content.

This is the way EA has to do it or else they would not be able to change the game at all. Adding new features requires adding new code and/or changing the existing game code. They give these additions/changes to players by issuing a patch. If you don't patch then your game code isn't changed. If your game code isn't changed then your game may be rendered incompatible with the current version of the game.
EA has been kind enough to keep the patches backward compatible for us so that CC made with older versions of the game will still work in newer versions of the game. What they cannot do is create new features that automatically work in someone's game if that person doesn't update their game. This is sort of a case of "you can lead a horse to water, but you can't make him drink". EA is giving you the option of sharing in new features and having a game that is compatible with everyone else's. You can choose to avail yourself of this option, or you can choose not to. If you choose not to, and new content won't work, that's your choice, but it isn't creators making content that doesn't work. The content those creators are making does work...your unpatched game just isn't compatible with it due to your choice to not patch.
